What Must I Disclose?
Sellers must disclose and explain any knowledge of pyrrhotite in the foundation, and later legislation requires disclosure of significant foundation defects and created a private right of action for buyers.
Does Not Testing Protect Me?
The obligation attaches to knowledge, and buyers already discount untested foundations in the window as though they were bad. Testing usually converts a discount into a fact.
Why Do Buyers Want an Inspection Before Closing?
Because a purchaser after 1 February 2019 needs an engineer's report issued before closing to be eligible for a claim.
